10/04/14: Law Change in Florida Benefits Drivers Convicted of Drug Crimes
A long standing, and counter intuitive, law in Florida held for mandatory two year driver’s license suspensions following convictions for drug related crimes such as possession of marijuana and possession of a controlled substance. The law is clearly counter intuitive to the rehabilitory process inherent at the heart of the criminal justice system in the United States for obvious reasons.
If a person convicted of a drug crime is to succeed post conviction (where the vast majority of such are placed on probation) it is incredibly important that they be allowed an oppurtunity to gain employment and become/remain productive societal participants. The loss of driving privileges acts as an immediate road block to that end for any person convicted of a drug crime in Florida. The legislature recently passed a bill that has since become law that reduced the length of the mandatory driver’s license suspension for drug related crimes in Florida from 2 years to 1 year. While this obviously does not fully address the inadequacies present in contemporary Florida drug law it is a positive step in the right direction.
