  • Burglary of a Structure: Burglary of a Structure is statutorily defined as entering a structure with the intent to commit an offense therein.  A structure, for the purposes of this charge, is any building that is not intended to be occupied as a residence.  The most common “offense therein” is a theft.  Therefore the most common type of Burglary of a Structure charge will be one where someone allegedly enters a store to steal things from inside.  A Burglary of a Structure is a third degree felony punishable by a maximum of five years in prison.
  • Burglary of a Dwelling: Burglary of a Dwelling is statutorily defined as entering a dwelling with the intent to commit an offense therein.  Dwelling is a fancy way of saying a building or conveyance that is designed to be used as a residence or home. The most common “offense therein” is a theft. Therefore the most common type of Burglary of a Dwelling charge will be one where someone allegedly enters a house to steal things from inside. A Burglary of a Dwelling is a second degree felony punishable by a maximum of fifteen years in prison.
